Description

In Ubuntu 13.04, whenever I right click and chose OPEN FOLDER its only on first attempt the folder opens successfully "on top" of the window otherwise if I do the same for next time the folder opens in the background.

Please report this to Ubuntu launchpad bug tracker as this sounds like an Ubuntu bug, we simply call xdg-open so we have no control over OS behaviour.
